Terms and Conditionsfor events

SCOPE
These terms and conditions apply to contracts for the rental of rooms from ARE Hotelbetriebs GmbH (hereinafter referred to as Anklamer Hof), for the organization of events such as family celebrations, banquets, seminars, conferences, etc. as well as for all other related services and deliveries of the Anklamer Hof. Subletting or subletting the rooms provided is not permitted.

CONCLUSION OF CONTRACT
The contract is concluded through written acceptance by the customer of the offer made by Anklamer Hof. For private celebrations, the appointment is only binding once the general terms and conditions have been signed in writing by the customer. If the customer concludes the contract on behalf of a third party, it is not he, but the third party who becomes the contractual partner of the Anklamer Hof. The purchaser must specifically inform Anklamer Hof of this in good time before concluding the contract and provide the name and address of the actual contractual partner. If the customer clearly concludes the contract in the name of the third party or if the third party has commissioned a commercial agent or organizer to process the contract, the customer, agent or organizer is jointly and severally liable with the third party who becomes the contractual partner for all obligations arising from the contract Anklamer Hof. Regardless of this, the customer is obliged to forward all booking-relevant information, in particular these General Terms and Conditions, to the third party.

SERVICES, PRICES, PAYMENTS
Anklamer Hof is obliged to provide the ordered and promised services in accordance with these General Terms and Conditions. In the event of overbooking, the hotel is entitled to rebook a group or individual guests to another comparable hotel. The contractually agreed services are deemed to have been fulfilled by the replacement position. The client has no further claims against Anklamer Hof in this regard. The contractual partner is obliged to pay the Anklamer Hof prices agreed for these services. This also applies to related services and expenses of the Anklamer Hof towards third parties, insofar as the expenses and services were contractually agreed or approved by the contractual partner. The agreed prices include the respective statutory VAT. Invoices from Anklamer Hof without a due date are payable without deductions within 7 days of receipt of the invoice. In the event of late payment, Anklamer Hof is entitled to charge interest of 8% above the current discount rate of the Deutsche Bundesbank. The organizer reserves the right to prove lower damages and Anklamer Hof reserves the right to prove higher damages. For events that are calculated based on a specific number of people, the number of people registered serves as the basis for the calculation. In the case of multiple people, the actual number of attendees is the basis for the calculation. The Anklamer Hof is entitled to demand an appropriate advance payment at any time. The amount of the advance payment and the payment dates are agreed in writing in the contract. 50% of the services booked in advance are due 14 days before your event.

BRING FOOD AND DRINKS
The contractual partner is generally not allowed to bring any food or drinks with him. Exceptions require a written agreement. In this case a service fee or corkage fee will be charged.

NIGHT SLEEP
Our house is located in the middle of the city center and is therefore subject to strict noise protection regulations. Out of consideration for our neighbors, the doors and windows must be kept closed from 10 p.m. The volume on the terrace must be reduced to a minimum from 10 p.m. Pay attention to the music and its volume; if necessary, this will be regulated by the Anklamer Hof team. The Anklamer Hof team is authorized to give instructions to the DJ/musician. The instructions must be strictly followed. The organizer is obliged to have the DJ/musician he has booked sign these noise protection regulations in advance. Organizers and DJs / musicians are equally responsible for ensuring that the noise protection regulations are adhered to. The end of the event is determined individually between both parties for each event.

NO SMOKING IN PREMISES
Smoking is prohibited in our rooms. Smoking is permitted outside.

DECORATION & SETUP AND DISMANTLING OF TECHNOLOGY
The costs associated with setting up and dismantling, as well as any damage caused by attaching items, are borne entirely by the organizer. The latter must indemnify the Anklamer Hof in this regard. The Anklamer Hof reserves the right to charge a cleaning or expenses fee of up to €500.00. Fireworks are generally prohibited, even with prior approval from the city of Anklam. There is also a ban on throwing or scattering rice, flowers, confetti, etc. in front of the hotel and in the rooms.

USE OF THE EVENT ROOM
In the event of unscheduled renovations to the event room on the day of the event, we reserve the right to charge a corresponding conversion fee of a maximum of €250.

PERMITS 
The necessary permits for the musical performance and mechanical reproduction rights (GEMA) must be paid for by the organizer. During musical events, the doors and windows must be kept closed from 10 pm.

LIABILITY
The organizer is liable for damage to buildings or inventory caused by guests, employees or agents of the organizer and must indemnify and hold Anklamer Hof harmless. The Anklamer Hof reserves the right to charge a liability amount for damage to inventory at any events on the Anklamer Hof premises if necessary. The decisive factor for the amount is the value of the damaged item and the repair costs incurred. If necessary, the Anklamer Hof may require the organizer to take out appropriate insurance.

TECHNICAL FACILITY
No liability is assumed for the technical devices brought by the organizer. If technical work from outside companies is necessary, this will be invoiced to the organizer.

GROUP SIZE AND MINIMUM SALES
On Fridays, Saturdays and before public holidays, there is a minimum number of 60 adults for events in rooms 1 and 2. If the minimum number of people is not met, a minimum turnover of 60 people at €100.00 each is estimated. Individual agreements are excluded from this and will be listed in the contract or offer.

MIDNIGHT PACKAGE
Events that last longer than 00:00 will be charged a service fee of €120 net per hour or part thereof. From 2:00 am the flat rate is €200 net. The midnight flat rate applies until the last guest/technician leaves the event room.

LOSS OF OR DAMAGE TO PROPERTY CARRIED
Any exhibition or other items, including personal items, are stored in the event rooms at the organizer's own risk. The Anklamer Hof assumes no liability for loss or damage, except in the case of gross negligence or intent on the part of the Anklamer Hof. TERMINATION BY THE ANKLAMER HOF The Anklamer Hof is entitled to terminate the contractual relationship early at any time if one of the following points applies: a) the event endangers smooth business operations; b) the reputation and security of the house are at risk; c) in the event of force majeure; d) the general terms and conditions are not adhered to by the organizer. In such cases, the organizer is under no circumstances entitled to assert claims for damages.

WITHDRAWAL OF THE ORGANIZER
Cancellations must be made in writing. If the organizer withdraws, the following occurs: Free cancellation is possible up to 6 months before the start of the event. 6 to 3 months beforehand 50% of the total amount arises, 3 to 2 months beforehand 60% of the total amount arises, 2 months to 1 month beforehand 80% of the total amount arises. From 1 month in advance, costs amount to 100% of the total amount. The basis for calculation is the minimum turnover of € 100 per person in food and drinks per day. The number of people taking part in the event must be communicated to Anklamer Hof 7 working days before the start of the event. This information serves as the basis for calculation.

CANCELLATION AND RETURN OF BOOKED HOTEL ROOMS (CANCELING, CANCELLATION, NO-SHOW)
Cancellations must be made in writing. If the organizer cancels all booked rooms, the following occurs: 60 to 30 working days beforehand 30% of the total amount, 29 to 14 working days before arrival 50% of the total amount and from 14 days before arrival 100%. However, individual rooms (up to three rooms) can be canceled free of charge up to 14 working days before arrival. The above regulations regarding compensation apply accordingly if the guest does not use the booked room or the booked services without notifying us in good time (no show).

FINAL PROVISIONS
The organizer's terms and conditions do not apply unless they are expressly accepted in writing by Anklamer Hof. Changes or additions to the contract must be made in writing and accepted by both contracting parties. Unilateral changes or additions by the contractual partner are invalid.
